Feyzioğlu to the SEC: It is not your job to write the law

Union of Turkish Bar Associations Chair Metin Feyzioğlu, saying the ‘unstamped vote’ resolution was unlawful, has commented, ‘The SEC’s job is to apply the law, not write the law,’ and ‘I am astonished at the SEC’s inability to understand something that everyone who is literate in Turkish understands.’

Union of Turkish Bar Associations Chair Metin Feyzioğlu has said, ‘It is the Supreme Election Council (SEC)’s job to apply the law, not write the law.’

The meeting of the expanded Black Sea Bar Association No 9 Chairs was held in Bartın’s Amasra sub-province. Feyzioğlu said in a statement he made to members of the press prior to the meeting that the SEC’s ‘unstamped votes’ resolution was unlawful. Feyzioğlu said, ‘It has no basis and I have never seen or heard such a decision in my life. I am astonished at the SEC’s inability to understand something that everyone who is literate in Turkish understands. The law says, “Voting slips unstamped on their rear are invalid.”

I mean you would have to study for so long to produce reasons that can be understood and explained differently to enable you to claim that this is not so. Anybody who has been to school understands what this means. “Voting slips unstamped on their rear are invalid.” It is the SEC’s job to apply the law, not write the law. This is wrong and unacceptable.’

Feyzioğlu, stating that the SEC referred to a number of earlier resolutions but these were not precedents, continued, ‘In fact, all those resolutions predate the amendment to the law in 2010 and all those resolutions of the SEC applied to polling stations in a particular municipality or town. But, on 16 April it did something mind boggling. The Constitutional Court must examine this. But, unfortunately, misleading comments are coming from the political rulership.’
