Probe into the entire CHP adminstration

A probe has been launched into the members of the CHP Party Assembly thanks to a criminal complaint made by AKP President Recep Tayyip Erdoğan.

It has emerged that a probe has been launched against the entire membership of the Republican People’s Party’s Party Assembly into the announcement proclaimed following the party’s 6 November 2016 Party Assembly meeting.

According to a report by Rıfat Başaran of Hürriyet, the CHP Party Assembly convened extraordinarily last year and issued a statement about the detentions targeting the HDP and Cumhuriyet newspaper. Included in the four-point statement were the words, “The Palace and AKP administrators, who have aided and abetted the FETO, PKK and IS terrorist organisations, are the greatest threat to our democracy and our country’s survival.” On 8 November 2016, President Erdoğan in turn reacted to this statement by making a criminal complaint to Ankara Republic Chief Prosecution though his lawyer Hüseyin Aydın citing “defamation of the President”. AKP Headquarters also made a criminal complaint about the same statement citing Article 301 of the Turkish Penal Code regulating the offence of “Demeaning the Turkish people, the State of the Republic of Turkey and the state’s institutions and organs.”
 
As part of the ensuing investigation, case reports into the charge of “defamation of the president” against the Party Assembly member MPs were compiled and sent to parliament. Authorisation is awaited from the Ministry of Justice for the conducting of a probe into the offences in Article 301 of the Turkish Penal Code. As to those Party Assembly members who are not MPs and have been severed from the case, the investigation into them continues. If the MPs’ immunity is lifted, all the Party Assembly members including Kılıçdaroğlu may appear before a judge.

CHP Deputy General Chair Bülent Tezcan has argued, “Even the compiling of a case report testifies to the degree to which what was written is true.” Istanbul MP İlhan Cihaner, about whom a case report has been drafted, said, “A probe is being launched into a party’s entire Party Assembly for the first time.”
